REFFERRED TO AS Pawfectchis)
BILL OF SALE
The consideration of this sale is $750.00 + $37.50 GST ($787.50)
(PAYABLE TO: Tammie Malkow-Dunham or Pawfectchis) to be paid before
the puppy leaves the breeder’s possession. Final payment for this puppy
will be a certificate of spay/neuter provided by the attending veterinarian.
HEALTH GUARANTEE
Pawfectchis guarantees that this Chihuahua has been Vet examined,
current on shots & dewormed. This Chihuahua is being sold in a healthy
condition & to the best of Pawfechis knowledge is free from any physical
or, mental condition which will now or, in the future, have any bearing on
this Chihuahuas health or, well being. Your own licensed Veterinarian
must examine this Chihuahua within seventy-two (72) hours from the
time of purchase. Failure to do so will relieve Pawfectchis of all liability.
If the veterinarian finds anything seriously wrong with the puppy, the
Buyer(s) may return the puppy for a full refund of the purchase price.
Buyer(s) may return this Chihuahua for any health reason, at the buyer
(s) expense, within seventy-two (72) hours. Pawfectchis will refund the
purchase price, less Two hundred and fifty dollars ($250.00) non-
refundable fee. Pawfectchis will not be responsible for any disease/illness
the puppy contracts after leaving our possession. Should the puppy die of
mysterious circumstances before being returned, it will be the buyer's
responsibility to obtain an autopsy on the puppy to determine the cause
of death on the puppy. If the buyer does not have this puppy vet
checked within 72 hours for their own protection, the buyer agrees to
take the puppy as is with no warranty whatsoever. Any signs of neglect
or abuse will void this agreement.
NEUTER/SPAY
All Pawfectchis Chihuahuas are sold on a non-breeding agreement. Under
the terms of the non-breeding agreement, this Chihuahua shall not be
used for any breeding purposes. The buyer(s) agrees to neuter/spay this
Chihuahua before Six (6) months; a copy of the neuter/spay certificate
must be given to Pawfectchis. It is clearly understood that this Chihuahua
is purchased strictly as a pet & shall not be used for any breeding
purposes whatsoever. The neuter/spay is not part of the purchase price
therefore, is at the buyer(s) expense and must be done. Should the buyer
(s) decide to violate our neutering/spaying agreement, the buyer(s)
agrees to pay Pawfectchis an intact fee of five thousand dollars
($5000.00), before this Chihuahua is Six (6) months. This fee will not
entitle the buyer(s) to breeding rights on this Chihuahua.
TRANSFER OF OWNERSHIP
Should the buyer(s) decide to relinquish ownership of this Chihuahua for
any reason. The buyer(s) will immediately return this Chihuahua to
Pawfectchis, at the buyer(s) expense. Pawfectchis will take possession &
responsibility for this Chihuahua for the price of one (1) dollar. No other
monetary compensation will be given.
If the buyer(s) knows of someone who would like to purchase this
Chihuahua, Pawfectchis must approve of the new buyer(s). Such
approval will not be unreasonably withheld on condition that the new
owner(s) agrees in writing to be bound by the provisions of this
agreement, including the non-breeding agreement.
GENERAL
The buyer(s) certifies that he/she is not an agent for another individual,
pet store wholesale/retail place where dogs are retailed to the public. The
buyer(s) agrees under no condition is this Chihuahua to be used in any
research institution or, to be taken to an animal shelter or human society .
The buyer(s) agree throughout this Chihuahuas life to provide proper
fenced area. The buyer(s) agree not to chain or, tie up this Chihuahua or,
let this Chihuahua run at large. The buyer(s) agrees not to abuse this
Chihuahua in any shape or, form. Under no circumstances is this
Chihuahua to be used in dogfights. Failure to comply will result in all
guarantees becoming null & void.
The buyer(s) agrees to notify Pawfectchis of any change of address or,
telephone number within One (1) month of change. The buyer(s) agrees
to let Pawfectchis know from time to time the progress of this Chihuahua.
The buyer(s) agrees to give Pawfectchis reasonable access to this
Chihuahua, should Pawfectchis request.
Should any of the conditions of this contract not be met or maintained by
the purchaser, Pawfectchis will send written notice (either by email or
Canada post) for the purchaser to immediately surrender the dog back to
Pawfectchis. If the purchaser fails to return the dog and all paperwork
IMMEDIATELY when requested legal actions will be undertaken for breach
of this contract. Pawfectchis reserves the right to immediately repossess
the dog and all paperwork. Pawfectchis reserves the right to pursue all
legal actions available to them under the law including pursuit in court for
the return of the dog to the breeder, compensatory damages, attorney
fees and any court costs.
Violation of this agreement shall entitle Pawfectchis to Three Thousand
Dollars ($3,000.00) in liquidated damages. Any legal action filed by either
party in an effort to enforce this contract, will be filed in the City where
Pawfectchis resides. All legal costs shall be borne by the buyer(s), should
Pawfectchis have to take legal action. By his/her signature below, the
buyer(s) acknowledges his/her understanding of and, agrees to the
terms of this agreement.
PLEASE REALIZE THIS IS A LEGAL BINDING CONTRACT, I CANNOT
STATE THAT ENOUGH
I, THE PURCHASER HAVE READ, UNDERSTAND, SIGNED, DATED AND DO
FULLY AGREE TO ABIDE BY ALL THE CONDITIONS IN THE ABOVE
PARAGRAPHS OF THIS CONTRACT AS STATED ABOVE BY “Pawfect
Chihuhauas Kennel & Dog Breeding."
